Fisher & Paykel Healthcare Successful in German Court Proceedings

Fisher & Paykel Healthcare Corporation Limited (NZX:FPH, ASX:FPH), announced today that the District Court in Munich has overturned both preliminary injunctions previously granted to ResMed, Inc against Fisher & Paykel Healthcare’s German subsidiary, Fisher & Paykel Healthcare GmbH.

In August 2016, the District Court in Munich granted two preliminary injunctions preventing the sale of F&P Simplus, Eson and Eson 2 masks in Germany by Fisher & Paykel Healthcare GmbH. In a hearing on 17 November, the District Court ruled to overturn the first preliminary injunction.

In a subsequent hearing on 1 December, the District Court ruled to overturn the second preliminary injunction. Consequently, Fisher & Paykel Healthcare GmbH has resumed sales of F&P Simplus, Eson and Eson 2 masks in Germany.

Lewis Gradon, Managing Director and CEO said “We are pleased with the outcome of the first two hearings in these patent dispute proceedings and we remain confident in regards to future proceedings. We thank our loyal customers and patients in Germany for their patience during this period.”
